Coordinating Minister for Political, Legal and Security Affairs Mahfud Md conveyed that there were no legal issues related to the Extraordinary Congress (KLB) Democratic Party (PD) which is called illegal in Deli Serdang, North Sumatra (Sumut). Mahfud said that the current official PD board was the eldest son of Susilo Bambang Yudhoyono (SBY), namely Agus Harimurti Yudhoyono (AHY).
“If asked whether after the KLB in Medan or in Deli Serdang Medan and for the government we are not talking about legitimate and illegitimate, now because for the government there is no official KLB report yet,” he said. Mahfud via video recording to reporters, Saturday (6/3/2021).
“So there is no legal problem. Now the official board at the government office is AHY, son of Susilo Bambang Yudhoyono,” he continued.
Mahfud said the government considered the event that was claimed by the KLB PD it was a meeting between cadres, but it could not be prevented, because there were regulations. Mahfud said, organizing an KLB requires an official notification.
“Until now, the government considers that there has been no case of an outbreak of the Democrat Party, because if there is an KLB there should be an official notification as an KLB, who the management is. So we consider those in Medan to be a cadre meeting which cannot be prevented,” he said. .
Mahfud said the public has the right to gather and hold general meetings, as long as they meet the requirements and do not violate the rules. Like holding a meeting in the palace to the arena of vital objects.
“If we obstruct it means violating the provisions of article 9 of law number 9 of 1978 concerning freedom of expression. It says that people are allowed to gather to hold a general meeting, as long as they meet certain conditions. What are the conditions, namely not in the state palace means that it does not violate the prohibition. Certainly not in a place of worship, not at school, not in a hospital, not in the arena of vital objects, please hold a meeting, “he said.
Furthermore, Mahfud conveyed that the government could follow up and decide whether the KLB was valid or not after receiving the report. Government said Mahfud currently in a position awry.
“So that if there are new developments later, for example from the KLB or for example from a group that stated that in Deli Serdang, then this report is the result, then the government will assess whether this is legal or not, adjust the law or not according to AD / ART or not, who is the new organizer? value later, “he said
