Through its official website, the Federal Prosecutor informed that he had deferred 11 clubs for alleged violation of art. 31 paragraph 1 of the Sports Justice Code: “The Federal Prosecutor, having carried out the disciplinary investigation activity and having examined the procedural documents, referred the clubs FC Juventus, UC Sampdoria, SSC Napoli to the National Federal Court – Disciplinary Section. FC Pro Vercelli 1892, Genoa CFC, Parma Calcio 1913, Pisa Sporting Club, Empoli FC, AC Chievo Verona, Novara Calcio, Delfino Pescara 1936 as their own responsibility, pursuant to art.31 paragraph 1 of the Sports Justice Code, for having recorded in the Financial Reports capital gains and rights to the services of players for values exceeding those permitted by the accounting principles to an extent that significantly affects, for some of the aforementioned clubs, the federal requirements for the issue of the National License, thus also violating the 31 paragraph 2 of the Sports Justice Code.
The same companies were referred by way of direct responsibility, pursuant to art. art. 6, paragraph 1, of the Code of Sports Justice, for the acts and behaviors put in place by their top managers endowed with the power of representation and for objective responsibility, pursuant to art. art. 6, paragraph 2, of the Code of Sports Justice, for the acts and behaviors carried out by top managers who do not have powers of representation.
With the aforementioned companies, 61 individuals were also referred who in various capacities have held the office of director or executive with powers of representation “.
