Theft of bracelet is expensive for Jumbo cashier

She also pays for legal costs and a bouquet of flowers that Jumbo gave to the injured customer. This is apparent from a decision made public yesterday by the Rotterdam subdistrict court.

Disappearance bracelet

The woman had worked for Jumbo for over 20 years and had an excellent track record. In February of this year, however, she was fired on the spot, due to the disappearance of a bracelet.


The bracelet of the brand Buddha to Buddha with a value of 269 euros was lost in the store by a customer. A colleague who found the bracelet handed it in to her when she was standing behind the service desk. The employee then placed the jewelry in a box with found objects.

The next morning the bracelet appeared to have disappeared. Jumbo then engaged a company detective for an investigation, which included viewing images from a security camera.


It showed that 20 minutes before the end of her shift, the cashier takes something from the cupboard and puts it in her pocket. Other employees who opened the locker did not take anything out.

Fired immediately

Because the woman had no explanation for what she took from the box, the researchers and Jumbo established that she was the one who had taken the bracelet. The woman was then evicted.


However, the cashier went to court to challenge her dismissal. She denied having stolen the bracelet before the Rotterdam subdistrict. According to her, that is not apparent from the camera images.

Therefore, the employee demanded her job back, and payment of overdue salary. In the event that she did not get her job back, the woman claimed severance payments of more than 117,000 euros.

Compensation

However, the cashier was also unable to provide a convincing explanation for what she had taken from the cupboard before the court. The subdistrict court therefore also assumes that the woman has removed the bracelet, and judges that the dismissal was justified.


It is therefore also unlikely that the woman will be able to claim unemployment benefits. To make matters worse, the subdistrict court also awarded Jumbo’s claim for compensation.

Bouquet of flowers

As a result, the woman has to pay for the reimbursement of the bracelet to the customer and the almost 2000 euros in costs of the detective agency that investigated the disappearance. She also pays for the 15 euro bouquet of flowers that the customer received as a saving grace.

Because Jumbo already deducted the aforementioned costs from her salary, they have already been paid. In addition, the Jumbo cashier still has to pay a so-called fixed compensation of more than 2000 euros. Employers can claim such compensation if they have to dismiss an employee on the spot.

Finally, the woman must also reimburse the legal costs of almost 1000 euros from Jumbo.
