Uruguay will resume vaccination against covid-19 for those under 13 years of age after the Court of Appeals revoked the first instance ruling in which a magistrate suspended the inoculation after making room for the protection presented by a lawyer.
This was reported this Tuesday by the Minister of Public Health of the South American country, Daniel Salinas, in a publication on his Twitter account.
Minutes later, the deputy minister, José Luis Satdjian, used the same social network to announce that Vaccination for children between the ages of 5 and 13 will resume this Thursday.
In its ruling, the Court of Appeals highlights that the lawyer who filed the amparo “has no legitimacy” to promote this action, “neither in his capacity as a lawyer and citizen, nor on behalf of the diffuse interests of minors under 13 year old”.
“In systems like ours, where there are organizations that are responsible for ensuring children’s rights, such as the Public Ministry, INISA (National Institute for Adolescent Social Inclusion), and various non-governmental organizations, It does not seem reasonable to promote an amparo action by citizens or inhabitants of the Republic, invoking representation of ‘diffuse interests’, alleging hypothetical dangers that are not proven“, he remarked.
Likewise, it indicates that there is no “illegitimacy” in the conduct carried out by the health authorities “for the purpose of preserving the health of the inhabitants in what constitutes their exclusive and exclusive competence, not being able to interfere with an organic system in what constitutes the exclusive sphere of competence of another system”.
“The current or imminent injury does not occur either because it has been vaccinated for thirteen or five months respectively with respect to minors.. No injury, restriction or threat to any right or freedom was proven in these actions since vaccination was never mandatory, it always was and is optional, ”he adds.
On July 11, the Government of Uruguay filed an appeal against the sentence issued four days earlier by Judge Alejandro Recarey, which forced the suspension of vaccination against covid-19 for those under 13 years of age.
The aforementioned error ordered the suspension of vaccination “immediately” and until a series of requirements stipulated by the judge were met.
