This time, Abbott did not back down. Instead, he issued a statement saying an “invasion under Article I, Section 10, Clause 3” of the U.S. Constitution was underway and invoked “Texas’ constitutional authority to defend and defend itself.”

Here, Governor Abbott answers an important question I raised during my 1988 run for President of the United States: at what point do open borders and mass illegal immigration into the United States become an “invasion” that would give governors the power — and obligation – to take action?

By some estimates, more than six million illegal immigrants crossed into the United States during the three years of the Biden administration. These illegals most likely come from Mexico and Central America, but the fact is that we have no idea how many of them may be arriving from, for example, the Middle East or other war-torn areas of the world.

With the world awash in American weapons, it is not difficult to imagine the danger of the situation.

It’s an issue the Biden administration is reluctant to address, possibly for political reasons, especially in an election year.

And Biden found an ally in the U.S. Supreme Court and Chief Justice John Roberts with the ruling that federal agents can begin removing barriers put up by Texas authorities. But the intensity of the dispute became apparent this time, when 25 Republican-led states issued statements in support of Texas.

It started to look like a clash and many even started referring to words like “secession”.

However, if the Biden administration intends to use the Supreme Court decision to take action against the Texas border barrier, there are more immediate ways to protect the border.

Representative Thomas Massey took to Twitter last week to recount a meeting he and a group of members of the US House of Representatives had with the late Justice Antonin Scalia.

At the breakfast, Massey wrote, Justice Scalia told the group to stop complaining about Supreme Court decisions and start defunding decisions they oppose.

As Massey explained in another tweet, “Congress can make the Supreme Court’s 5-4 v. Texas decision IRREVOCABLE by simply refusing to fund Biden’s rollback of border security measures.”

Nullification through the “power of the purse” is an important tool given to Congress in the US constitution and could easily be exercised in this case.

Biden is clearly playing politics with the immigration crisis, saying last week that as soon as Congress passes another immigration “reform” bill — one that includes $100 billion in military aid to Ukraine, Israel and Taiwan — he will take steps to address with the Border problem.

Congress must reject this blackmail, and American states must continue to take measures—including overturning the Supreme Court’s decision—to protect against invasion.
