(CNN) – The government of President Donald Trump presented a proposal that would triple some fees for the documents presented before the courts of immigration.
The measure would make it more expensive to submit certain forms, such as those for appealing rulings and, as a result, will likely represent a challenge for immigrants seeking relief. The increase in rates could also deter immigrants from appealing their deportation cases.
For example, a form to appeal a decision by an immigration judge costs $ 110. The administration proposes an increase that would make that document cost $ 975.
Two forms for those requesting the cancellation of removal are also included in the list of proposed rate changes, from $ 100 to more than 300. In some cases, an individual may request a fee waiver, in accordance with the text of the rule .
In November 2019, the government also proposed a fee for asylum applications, the first time the government of U.S has charged for the form, as well as a 83% rate increase for the naturalization form.
The last proposed changes come from the Executive Office for Immigration Review (EOIR) of the Department of Justice. The office, which oversees the nation’s immigration courts, determined that an updated assessment of the costs of processing forms and motions, as well as the corresponding fees, was necessary, in accordance with the rule.
“The rates have remained static, regardless of inflation or any other intermediate change in EOIR processing costs,” he reads.
The proposed rule will be published on Friday in the Federal Register and will not take effect until after a period of public comments and additional changes.
