The trial against Willy Toledo is still in progress and the Madrid Court will have to study the case | Spain

The legal case opened against Willy Toledo, for shitting on God and the Virgin on social networks, is still going on. And now it lands at the Provincial Court of Madrid. After Judge Sonia Agudo acquitted the actor of an offense of religious sentiment last February, the Association of Christian Lawyers has filed an appeal to correct that resolution and condemn him for his “rude and insulting expression of contempt and mockery of the beliefs of the Catholic religion. ” For his part, the interpreter’s lawyer, Endika Zulueta, has also announced that he will appeal so that the prosecution has to pay all the costs of the process.

“The Spanish courts have much more important matters to analyze than if people outrage virgins on Facebook. We are in the 21st century, not in the Middle Ages, where this association seems to be living, ”explained the lawyer from Toledo about a cause that started in 2017, when Christian Lawyer filed the first complaint. The actor had released a post of support to the three women accused of taking out in Seville a plastic reproduction of a vagina of almost two meters —a performance baptized as the procession of the unsubmissive pussy—: “I shit in God, and I have shit to shit in dogma of the sanctity and virginity of the Virgin Mary ”, read the letter.

The group also denounced a second message, broadcast on the occasion of the national holiday of October 12: “I screw up in the discovery. I shit on greedy and murderous conquerors. I shit on the Virgen del Pilar and I shit on everything that moves. Nothing to celebrate. Much to defecate. Boas noites ”. As Toledo related during the trial, he had no intention of offending the religious feelings of Catholics and framed them within the exercise of freedom of expression and political criticism.

Christian Lawyers rejects this thesis in their appeal, dated March 10 and to which EL PAÍS had access: “They constitute a rude and insulting expression of contempt and mockery of the beliefs of the Catholic religion, totally unnecessary to sustain this political criticism of through which the defendant intends to exonerate himself, ”says the document, where it is considered that Judge Agudo made an error in the evaluation of the evidence:“[El actor] He maintained that the objective was not to offend anyone. However, from the Facebook posts, from his own comments to them and even from his statements at the entrance and exit of the court, it is difficult to admit that he did not intend to make the stubborn mockery of the aforementioned religious feelings ”.

In her resolution, the magistrate of the Madrid Criminal Court 26 insisted that the style that “characterizes the publications” of the interpreter does not prove that she has committed a crime, although she admitted “the lack of education, bad taste and language soez used ”. In addition, the judge also decided to apply the principle of in dubio pro reo —In case of doubt, resolve in favor of the defendant—, since he considered that the accusation had not presented sufficient evidence to prove that Toledo wanted to offend the feelings. “It is always easy to say that this was not what was intended,” reproaches Christian Lawyers in his new writing, where he adds: “If this had not really been his intention, he could have apologized.
