Thwarted in her initial plans for the 35 hours, Anne Hidalgo returns, as promised, with a plan B. The socialist mayor of the capital will submit to the Council of Paris which is held from Tuesday to Friday new measures aimed at limiting the impact compliance with the legal obligation of 1,607 hours of annual work in the territorial public service.
As required by the law of transformation of the public service of August 2019 putting an end to the derogatory regimes, the City of Paris switched to it on 1is last January. With a device making it possible to mitigate the loss of 8 days of extra-legal leave resulting therefrom (possibility of generating new days of RTT in return for an increase in working time of a few minutes per day, granting of 2 days of leave for agents who will take 8 days off in a row in winter).

But without the provision of the working time regulations adopted in July 2021 which provided for giving 3 additional days of RTT to the 50,000 agents on the grounds of specific hardship linked to working in the capital. This “city-capital subjection” had been suspended in summary proceedings by the administrative justice – before being canceled by the administrative court in March.
With the deliberation which will be submitted this week to elected officials, the Paris town hall will play on other levers – as other municipalities have been able to do. In particular, by reviewing the grid of “subjections” which make it possible to grant reductions in working time to take into account difficult work rhythms or conditions. “Modifications have been made to adjust the annual working time due by agents performing the most arduous jobs or subject to cycle constraints, such as shift work or night work, in order to establish a fairer level of arduousness”, explains Anne Hidalgo in the explanatory memorandum.
For agents with variable hours, it is expected that they can generate, “by working a few minutes more each day, up to 27 days of RTT”, i.e. 3 more than in the deliberation of July 2021. Between these two provisions, “no City agent is left out. They do not recover every 3 days which were planned with the city-capital subjection, but 80% of them recover between 2 and 3 days according to different methods and the others 1 day, “explains to “Echos” Antoine Guillou, l assistant PS in charge of human resources.
Call to strike
Not enough to satisfy the inter-union always mobilized behind the slogan “Not a minute more” and which calls for a new day of strike Tuesday. “Despite some modest proposals for improvement, we are very far from the mark. The executive has not returned, at a minimum, to all staff the three days of city-capital subjection to which the Mayor had nevertheless committed, ”she laments.
The City of Paris had also wondered about the possibility of a “bonus” of hardship related to age. She had written at the end of March to the Minister of the Public Service at the time, Amélie de Montchalin, to have “a ministerial interpretation” on the subject, such provisions having been the subject of appeals against certain communities when they were not disputed in other departments. Failing to have obtained an answer, it intends to question the government again, indicates Antoine Guillou.
