The tender for the Ioannina-Kakavia project is frozen again

A new appeal by technical companies stops the development of the tender for the road project “Extension of Ionia Road section: Ioannina-Kakavia”, budget 310 million euros.

The tender in question has already been canceled once by decision of the Unified Authority for Public Contracts (E.A.D.I.S.) which accepted an appeal by Domiki Crete, EKTER, ERETVO and TE.NA. The aforementioned four construction companies argue that the conditions set by the project announcement prevent smaller companies, even if they form a joint venture, from competing with the industry’s powerful groups.

The Ministry of Infrastructure and Transport at the beginning of May re-announced the project, setting June 22 as the date for submission of bids.

However, the same companies appealed again to E.A.D.I.S.Y. against and the new proclamation. The new appeal will be heard on July 7. The Authority accepted the request for suspension and temporary measures included in their pre-trial appeal and suspended the development of the tender process, until the issuance of a final decision on the pre-trial appeal.

As can be seen from the relevant documents, the 5th Echelon of E.A.D.I.S., met on June 6 to examine the request for suspension and taking temporary measures, which is included in the pre-trial appeal from 05/30/2023 of the association of the four companies.

With the pre-trial appeal, the applicants request that the announcement of the open tender of the project “Extension of the Ionian Road section: Ioannina-Kakavia” be canceled in the part that concerns “the additional requirements and the conditions of the Professional and Technical Ability of article 22.D of the announcement , as well as any condition that hinders the summation of the minor capacity and qualifications of the participants in an association of economic operators”.

Although the applicant consortium acknowledges that the “announcement in question was allegedly amended, in order to comply with the previous decision of E.A.D.I.S.Y.”, however, it maintains, “that the announcement, in its new form, includes an incorrect and disproportionate methodology for measuring the minor experience of several economic operators, while also pointing out that there is a case of faulty compliance by the contracting Authority”.
