No illegitimacy regarding the decision of Province of Salerno to abolish his police force. This is what was established by the judges of the first section of the Tar of Salerno (president Salvatore Mezzacapo) which yesterday rejected the appeal presented by six former Provincial agents who had asked the court to “cancel” the resolution of the Provincial Council led by the president Franco Alfieri of 26 May with which the institution of the Corps was revoked 1997. During the hearing held last week, the Province highlighted that the six former agents would not have suffered any prejudice, as they continued their work commitments in the same tasks. A situation, however, contested by former agents who highlighted how «the suppression of the Corps to which they belonged led to the loss of their public status, so that from being public officials, the appellants would in theory be downgraded to mere provincial employees».
The motivations
In the appeal, however, the appellants had highlighted among the various reasons the failure to communicate the start of the dissolution of the provincial police, the illegitimacy of the acts due to “defect in the conditions” since, previously, the Palazzo Sant’Agostino would provide reassurance on the maintenance of the Corps, the non-existence of the revocation in the absence of reasons of public interest, the irreplaceability of the provincial activities, the contradictory nature of the administrative action as the agents were then classified into two different groups which continued the activities previously carried out by the Corps.
