A case of domestic violence is always complicated to judge. When it involves a special forces soldier, like the one examined in immediate appearance Wednesday, May 18, it is only more difficult, less “ordinary”.
Because “a soldier is a person vested with public authority“. Because “one is a soldier in everyday life, including in his private life”. Because among the first qualities that a soldier must possess, there are “know how to keep your cool”according to the public prosecutor.
“The army is another world”
“Is this a trial of sexism, of men, of the military?”asks the defense attorney. “I am trying to make you realize that the army is another world, such a special world”, he pleads in particular.
The soldier from Bricy, 37, has been married since 2017in a relationship since 2014. Together, they had almost 3 year old girl. According to his wife, the man had a particularly bad experience of an external operation four years ago. Since then, “he is not well”; after his work week, he ‘unloads’ on her on weekends, she says. And in particular this May 15 in the morning, the day when Madame went to the Patay gendarmerie with her child to denounce the violence of her husband.
Recurrent verbal abuse
A “forehead against forehead”, a “whim”? Interpretations differ. A total incapacity for work of one day is pronounced. Two other episodes of physical violence are mentioned, facing the gendarmes: the fact of having been pushed into the cedars at the end of 2021 and, in December 2018, when she was three months pregnant, to have a frozen hamburger in the head. The victim also complains of recurrent verbal abuse, insults, death threats.
At the hearing, the mother of the family nevertheless deplores that “we talk about my husband like a monster when we still have very good times”. She insists : “I went to see the gendarmes because I no longer knew how to help him.”
“I don’t get angry for nothing”
“I’m sorry. She put me to the end. I wanted to push her, not impact her”, explains, for his part, the defendant, about the most recent facts. And the frozen burger? “She broke two tiles in the house on purpose by throwing plates on the floor!”
“You don’t have a problem with women?” Asks the president, referring to the different behaviors and thoughts of the person concerned. “I don’t get angry for nothing,” he replies.
Mandate of deposit required
This is not the opinion of the public prosecutor for whom “psychological follow-up is absolutely necessary to work on the relationship to women and violence” ; it requires, among other things, eighteen months including ten months suspended, and a warrant of deposit.
The court sentences him to twelve months, six of which are accompanied by a two-year probationary period.The firm part can be carried out under an electronic bracelet. The violent husband will have to submit to an obligation of care and is prohibited from going to the family home. He was not kept in detention.
