/ world today news/ A little more than a year after the bankruptcy of KTB, the looting of the bank’s assets is in full swing. From documentation, a copy of which BGNES has, it is clear that assets of companies that are debtors to the bank are being sold off, but at prices ten times lower than market prices.
And the money from the looting goes to private companies instead of the bankrupt vault. In the specific case, it is about the sale of 29 Scania trucks, one tractor and two water carriers of the same brand in good condition and under 100,000 kilometers, the market value of which is between 40 and 50,000 euros, and they were sold a week ago for 10,000 BGN each. All this is happening in the midst of the holiday season and with the cooperation of the state authorities.
The background in brief. On December 28, 2012, “Agrokomplekt” EAD concluded a lease agreement for 32 Scania heavy-duty vehicles with “Partner Leasing” AD. The initial contract of the construction company “Agrokomplekt” is with “Scania Finance Bulgaria” EOOD. The total value of the lease is €3,238,845.80 or around €100,000 per truck. At the moment, the company has paid about 2.5 million euros of the amount owed, which is 75% of the remaining value. Due to financial difficulties, “Agrokomplekt” EAD requested “Partner Leasing” to renegotiate the terms of the lease, and written correspondence was exchanged for this purpose.
However, on July 2, 2015, the lessees from “Agrokomplekt” were informed that “Partner Leasing” had transferred “all their claims and rights under their contract with “Agrokomplekt” EAD dated December 28, 2012.” of “Hidropark 2011” EOOD. Buyers of the trucks are also being notified that their finance lease will be terminated with one week’s notice. A few days later, on July 28, 2015, 16 of the Scania dump trucks were already sold at the Hidropark 2011 auction. In practice, the manager Vitali Zolotaryov brought 16 trucks into his company for a total of BGN 160,000 at a market price of at least BGN 1,300,000, which trucks are, according to documents, in the assets of KTB. The contract was duly certified by notary Milena Georgieva. Julian Indjov with “ISA 2000 EOOD” made the same attack on the same day – July 28, with the rest of the trucks at 10 times below their market price. Julian Indjov became popular with his attempt to finance the football giant CSKA, relegated to the Third Division.
In quick succession, just one day after the sale was completed, on July 29, 2015, new coupons were issued to the heavy goods vehicles, in which “ISA 2000” EOOD and “Hidropark 2011” EOOD were entered as owners.
On July 30, 2015, representatives of the two companies, who are the “new owners”, accompanied by the police, appeared on the Maritsa highway, which is currently under construction, to take possession of the trucks, which until last Thursday were used by “Agrokomplekt” during the construction of the road facility.
The company “Agrokomplekt” EAD, which was established way back in 1974, is categorical that the actions of the leasing company “Partner Leasing” and the two other companies “buying” the heavy-duty equipment are illegal. Because of this, on August 5, the Sofia District Prosecutor’s Office was also referred. According to the applicants, there are two special lien contracts in relation to the “seized” heavy goods vehicles, which have not been terminated and which constitute an obstacle to the transfer of ownership. “Agrokomplekt” claims that the actions described caused damage to the state budget through non-payment of VAT, as well as to the creditors and depositors of KTB, since in practice the trucks sold for nothing are owned by the KTB treasury through the two special pledge contracts in question , which have not expired. Exactly one year ago at this time, it became clear that “Partner Leasing” AD is among the largest borrowers and, accordingly, debtors to the treasury of Tsvetan Vassilev. The liabilities of the leasing company to KTB amount to between BGN 110 – 136 million according to various estimates. The company managed by Yavor Ninov was one of the first that the newly appointed conservators of KTB demanded to be declared bankrupt, but instead, for inexplicable reasons, it was acquired by the Varna collection company “SG Group” OOD of Stanimir Burgaski and Adam Sotkov. Two days ago, the manager of “Partner Leasing” Yavor Ninov was replaced, which raises doubts about covering up the traces of this and other similar “deals” and will make it almost impossible to cover the over 110 million debts owed to KTB. At the same time, the company in question, specialized in “collecting and assigning debts” has started to sell off other assets that are actually owned by KTB for a pittance. “Agrokomplekt” informed in writing about the looting of “Partner Leasing” the trustees of the bankrupt bank Lazar Iliev and Rosen Angelchev, whom the government assigned to protect the interests of the Deposit Guarantee Fund, which is currently the largest creditor of KTB. The calculations of the victims of the described scheme show that the losses for the FGVB, respectively the taxpayers and the “burnt” depositors, amount to about BGN 1.5 million, without taking into account that in practice “Agrokomplekt” has been placed in an impossibility to fulfill already concluded contracts, with which she would also pay off her obligations to the lessor. For this purpose, in their report to the prosecutor’s office, the company requested the seizure of the trucks until the case is clarified, due to the possibility that the equipment may be transferred to other persons.
Expect details from the investigation on which accounts the sums for the trucks were paid by “ISA 2000” EOOD and “Hidropark 2011” EOOD to “Partner Leasing” in the situation that the leasing company’s accounts are blocked by KTB, as well as the actions of the state against this and other cases of secondary looting of KTB’s assets.
