Do military commissars have the right to detain men when serving a summons?

Representatives of territorial recruitment and social support centers may detain people only in cooperation with the policeand only if a certain offense occurs, says Anton Marinich.

“There are also so-called authorized persons or patrols. They include both representatives of the National Police and the military of the National Guard. They must be appointed by order of the commandant. The commandant must issue an order or other administrative documents, which must indicate what exactly these can do persons. There are two separate regulations that determine what these authorized persons can do during the period of martial law. This applies to work at checkpoints, and inspection of housing and office premises, and inspection of a person’s belongings,” explains the specialist.

The detention itself must take place if there has been any crime. And if a person simply refuses to receive a summons and at the same time behaves nervously and aggressively, even such a circumstance should hardly become a basis for detention, the lawyer says.

According to him, if a person is detained openly outside of legal methods, then calling only a lawyer will not solve much. Therefore, you should complain to several authorities at the same time.

“If such a detention occurs without committing a crime, you can first of all complain about the actions of police officers to the DBI – State Bureau of Investigation. You can also contact the police, depending on which team works: only the TCC or the TCC and the police at the same time. If there is an outright violation on the part of law enforcement officials, you should complain to different authorities,” concludes Anton Marinich.
