The Right to Information and the Importance of Data Protection: How to Obtain and Enforce Your Rights under GDPR

The right to information guarantees you a significant right of data subject according to Art. 15 of the General Data Protection Regulation (GDPR). As the data subject, you can then request information from the person responsible for data processing about which data about you is stored or processed there.

This information must be given free of charge.

Unfortunately, it often happens that those responsible do not react at all or have only received insufficient information.

According to Art. 12 Para. 3 GDPR, the information must be provided within one month. An extension of the deadline is only possible in exceptional cases. However, the controller must then inform the data subject of an extension of the deadline within one month of receipt of the request, together with the reasons for the delay.

If the information is delayed, those affected may also be entitled to a claim for damages. You can also sue for information. Likewise, the lawyer’s fees for a further letter of formal notice can be claimed from the person responsible, since the person concerned is in default.
