Despite the above, the appellate court finds that the ruling of the Starozagorsk District Court, by which a remand measure was taken against G.G. measure of remand, can be taken against the accused person only within the framework of criminal proceedings for an act that is prosecuted in the general order (criminal prosecution that is conducted by the state prosecution). In the specific case, from the conclusion of the forensic medical examination of a living person , applied in the pre-trial proceedings, during the examination of the case, it was established that the described injuries of the victim, individually and in total, caused the same temporary health disorder, not life-threatening – minor bodily injury.

According to the provisions of the Criminal Code, the criminal act committed by the applicant (minor bodily injury) is prosecuted according to the order of private prosecution (filing of a criminal case by the injured person). This circumstance, according to the law, does not allow any measure of procedural coercion to be taken against him, including “Detention in custody”, which is why the accused is released.

At the beginning of 2023, G.G. was sentenced by virtue of an agreement approved by the District Court – Stara Zagora, by which he was sentenced to “probation” with the first two probationary measures, namely “compulsory registration at the current address” for a period of six months with periodicity twice a week, as well as “mandatory periodic meetings with a probation officer” for a period of six months for a committed crime under Art. 131, para. 1, item 12 proposal first in conjunction with Art. 130, para. 1 of the Criminal Code (slight bodily injury)”.
