    In connection with the position expressed by the prosecutor in the case that “the appeal in cassation is founded and proven”, the lawyer Karakusheva stated that “this is the personal judgment of the prosecutor, who presented himself at the hearing and took a judgment on the sentence, but did not present any arguments ”.

    “I believe that the cassation appeal is well founded and proven, and I ask that it be respected”, says the prosecutor in the case, as can be seen from the minutes of the meeting uploaded to the judicial system.

    The Ministry of the Interior states in its appeal that “the decision of the court of first instance is unlawful and was taken on the basis of an erroneous perception of the facts and evidence gathered in the case”.

    During the meeting, the representative of the internal function also stated that the arguments and facts described in the decision of the regional court do not correspond to the truth and do not correspond to the evidence attached to the trial file.

    According to lawyer Karakusheva, the complaint from the Ministry of Internal Affairs is unfounded and the first instance decision is correct and legitimate. We asked for the complaint to be rejected, she added. According to her, the district court justified itself in detail and added that there were many procedural violations related to the issuance of the detention order.

    On 17 March, former prime minister and leader of GERB Boyko Borisov, former finance minister Vladislav Goranov and GERB media consultant Sevdelina Arnaudova were arrested and released the next day without charge. They were caught by the police in an extortion proceeding linked to businessman Vasil Bozhkov. They subsequently appealed to the courts against the police warrants under which they had been detained. Borisov’s was canceled in two cases as illegal, including Arnaudova’s and Goranov’s, but only in the first instance.

    Attorney Karakusheva, who also represents Vladislav Goranov, indicated that the appeal of the Ministry of Internal Affairs in relation to his detention and the decision of the court of first instance will be considered in early December.

    On the occasion of the investigation for which Borisov, Arnaudova and Goranov were arrested, the lawyer specified that after their detention they were questioned as witnesses, but were subsequently neither called nor searched.
