In violation of the Law on Public Finances and the Law on Public Procurement, by concluding agreements to a contract with the Ministry of Foreign Affairs, Daniel Mitov obliged the Ministry of Foreign Affairs to transfer BGN 700,000 for the incriminated period /15.01.2016 to 31.07.2016/ to a commercial company. through the Ministry of Internal Affairs and Communications and did not provide control over the implementation of the price proposal under the agreements thus concluded.
This resulted in significant damages for the Ministry of Foreign Affairs in the amount of BGN 494,458.04 – an amount that represents an undue payment by the Ministry of Foreign Affairs to the Ministry of Foreign Affairs, due to the commercial company’s non-compliance with its price proposal – a crime under Art. 219 paragraph 1 of the Criminal Code.

The charge is a criminal proceeding initiated on 19.01.2017 by the SZA in connection with the non-execution of a public procurement by the MFA in accordance with the Law on Public Procurement for the provision of air transport, hotel accommodation and medical insurance during business trips established during the investigation for the employees of the Ministry of Foreign Affairs.
Instead of complying with the law, since there are grounds for conducting a procedure for awarding a public contract in accordance with the PPA, the former minister Daniel Mitov concluded two agreements /from 15.01.2016 and from 22.04.2016/ with the Ministry of agriculture and food, by virtue of which they used the services of a commercial company through the Ministry of Agriculture. With this commercial company, the Ministry of Health is in contractual relations after a public procurement was carried out for the provision of air transport, hotel accommodation and medical insurance during business trips for the employees of the Ministry of Health.
In the same criminal proceedings, on 05/04/2017, charges were brought against the former Deputy Minister of Foreign Affairs, Hristo Angelichin.

The Ministry of Health has conducted a public procurement. “Practically, we have protected the public interest by signing an agreement with them,” Mitov pointed out. He stated that he could not even understand what this allegation was about, given that if there was any wrongdoing it was with the company, which may have at one point taken more than the two ministries. Mitov and the Minister of Agriculture at that time signed this agreement between two ministries.
“From what was written in the indictment, I cannot in any way conclude that there was any crime committed,” he said.
