/ world today news/ Despite the threats of the chief prosecutor Sotir Tsatsarov, that the state prosecution has the will to bring to the end the investigations in CEZ, the National Electric Company and the State Commission for Energy and Water Regulation, to date the Sofia City Prosecutor’s Office has not filed a single charge of noisy the five investigations announced a month ago.
The five investigations began after an inspection by the prosecutor’s office in the three electricity distribution companies, DKEVR and NEK. The state prosecution activism came as a response to mass protests against high electricity bills that brought down the GERB government.
After a two-week reading of documents, the prosecutor’s office announced that the Ministry of Economy had failed to collect dividends from CEZ’s profits while it was still the owner of 33% of the company’s shares. In the period 2007-2011 profit was distributed only for 2010, despite the fact that every financial year ended in a profit. In 2011 the profit is 546 mln. BGN, at the end of 2012 – 593 million BGN 33% of these sums should have gone to the state, the prosecution claims. Because of these omissions, the public prosecutor’s office opened an investigation against unknown officials from the ministry.
In the same way – against unknown perpetrators – three more of the investigations were formulated. They are about unemployment and official crimes in NEK, DKEVR and CEZ. According to the prosecutor’s office, the state company has undertaken to buy 100% of the electricity produced by TPP “Maritsa-Iztok” 1 and 3. energy, although it was clear that the deal was concluded in a way that was not beneficial for the state and that NEK would suffer losses.
On the other hand, an investigation was launched against unknown employees of the State Environmental Protection Agency for the fact that in September 2012 applications for future high costs of green energy producing enterprises have been approved without any economic analysis. This type of electricity is bought at higher prices with the idea that it stimulates ecological production. Applications for provisional network access prices, which also indicate the costs in question, were submitted on 13 September 2012. They were approved the very next day by the CEWR, without it conducting an analysis. According to the prosecutor’s office, this is an official crime.
The prosecutor’s office is also investigating unknown persons in CEZ for deliberate bankruptcy. This pre-trial proceeding began on the basis of a report by the State Financial Control Agency, which found violations in some of the company’s 396 public contracts. Auditors found that in 2011 the Czech company did not hold tenders for 350 thousand BGN without VAT.
At the moment, the prosecutor’s office has not brought charges even in the only investigation that is being conducted against a known perpetrator – the former director of NEK Mihail Andonov. The state prosecution believes that he entered into an unfavorable contract for legal services and legal representation in the period September 15, 2011 – June 5, 2012. In addition, the prosecutor’s office announced that there will also be a charge of bankruptcy against him. It is based on a report by the National Security Agency, which is classified, and that is why the investigators refused to announce what Andonov had done.
