The Prosecutor’s Office denounces a possible fraudulent hiring at the General Hospital

VALENCIA. (EP) La Provincial Prosecutor of Valencia has denounced the possible fraudulent hiring of a position of a specialist in clinical analysis in the Valencia General Hospital and has asked the court to investigate it in case it had been committed a crime of embezzlement and prevarication.

This is stated in the brief, to which Europa Press has had access, which has been forwarded by the Public Prosecutor’s Office to the Dean Court of Valencia so that the appropriate criminal procedure may be initiated by the corresponding judicial body.

This case starts from a complaint filed by the Independent Trade Union and Official Central (CSIF) at the end of 2019 before the Prosecutor’s Office, in which it was revealed that the Consortium Hospital General Universitario de Valencia had covered, through a long-term employment contract determined, a faculty specialist in clinical analysis fraudulently.

To fill this position, a person was replaced on the occasion of their union liberation. As reported by CSIF, over a period of several months, a person was released from his job to form part of an Integration Commission that “did not exist functionally” and to fill his position, another doctor was used in a “fraudulent” manner.

In this way, during all that time, both specialists were collecting their salaries, guards and pay while one of them was released. The global expense for this double contract situation amounted to almost 50,000 euros.

Regarding the non-existence of the Commission, the union maintains its absence of functionality on the basis that there has been no communication of its creation, of whom it was composed, nor of reports or minutes of the sessions held.

In addition, the alleged fraudulent contract was supposedly maintained in the plaza once the cause that motivated the hiring expired, thus contravening the procedures established for this purpose for the temporary coverage of basic places. This is the Resolution of June 15, 2016, which approved the regulatory standards for determined hiring and job improvement.

It has also been understood that other more far-reaching regulations have been violated, such as Law 7/2007, of the Basic Statute of Public Employees, specifically article 55, and even the provisions of articles 23 and 03 of the Spanish Constitution.

The Valencia Prosecutor’s Office, after studying the facts denounced, has agreed to transfer them to the court so that possible criminal responsibilities in the case in which they exist are cleared.
