The President of the Supreme Audit Office Marian Banaś reported to the prosecutor’s office against his deputy, former MP of Law and Justice, Tadeusz Dziuba. The notification concerns a suspected abuse of rights by a public official.

Onet announced on Tuesday that Bogdan Skwarka, director of the Public Administration Department of the Supreme Audit Office, in mid-June wrote a letter to the Vice President of the Chamber Tadeusz Dziuba – a member of Law and Justice in 2011-2019 and the head of the local authorities.

Marian Banaś, head of the chamber, reacted to Dziuba’s actions. The Supreme Audit Office confirmed that Banaś “sent a notification to the prosecutor’s office about the suspicion of committing a crime under Art. 231 of the Penal Code by Vice President Tadeusz Dziuba.” It was added that the president of the Supreme Audit Office applied to the Marshal of the Sejm for his dismissal. Article 231 of the Criminal Code refers to the exceeding of powers or failure of a public official’s duties.

§ 1. A public official who, by exceeding his authority or failing to perform his duties, acts to the detriment of the public or private interest, shall be punishable by imprisonment of up to 3 years.

Members ask about independence of controllers

The Supreme Audit Office launched an ad hoc audit on Wednesday in connection with the preparation of the presidential election, which was ordered on May 10. In connection with the commencement of the audit, the opposition asks about the independence of the House’s controllers. Krzysztof Gawkowski, head of the Left Club, who requested the NIK audit on the May 10 election, pointed out on Thursday in the Sejm that “after what President Tadeusz Dziuba is doing, among others, it will be impossible to conduct a thorough audit.”

Piotr Zgorzelski, the Sejm Deputy Speaker of the Polish Coalition, also referred to the issue of control. – In my opinion, PiS will do everything to prevent disclosure of all materials that could plunge, be it the Minister of the Treasury or someone else – he said. – If it actually starts (audit), then there will also be a test whether Mr Marian Banaś is the true president of the Supreme Audit Office or is still on the PiS links – he added.
