Lawyer Arturo Salas, from the Solidaria Perú organization that assists victims of police repression, said in an interview with El Búho that the circumstances in which the investigations are carried out could generate impunity for the deaths of protesters. Salas is a representative of the fatal victim who registered in Arequipa on January 19 and of other victims registered throughout the demonstrations.
The victim’s mother, Giancarlo Condori Arcana, declared that she leaves two girls aged 11 and 4 as orphans and that she was not participating in the demonstrations. According to the autopsy protocol, Giancarlo’s death was caused by hypovolemic shock, by perforation of the ascending aorta, penetrating blunt wound to the chest by a firearm projectile.
Lawyer Salas explained that 4 metal pellets hit the victim’s body. One of them perforated the ascending aorta and that caused the internal bleeding that caused him to lose his life.
Victim was not participating in the protests according to relatives
According to the statement of the deceased’s cohabitant, Giancarlo left at 6 in the morning to work. She was unaware of her participation in the protests. Other relatives mentioned that he was circumstantially in the area. The lawyer mentioned that, as the investigations progress, it will be certain how he ended up in the area and received the impacts of the pellets.
He mentioned that they are awaiting the results of the expertise that the prosecution has ordered. However, she said that from experience it could be affirmed that it occurred face to face, calculating a distance of 15 to 20 meters between the victim and cash. In addition, it is produced illegitimately since they were metal pellets, which have been prohibited in Peru since 2010.
He also pointed out that the shooting violated the protocols that indicate that the shots are dissuasive and are fired from the waist down. “In this case, the cash had the purpose of causing his injuries since he was shot at the level of the heart,” he said.
The lawyer hopes that the government puts an end to so much death, since they are the ones who authorize the use of these weapons in an excessive way.
Public Ministry does not act with due diligence to avoid generating impunity
Salas also made a statement in the form of a complaint, asking that the representatives of the Public Ministry act with due diligence. The lawyer pointed out that in the case of one of those who died in Chala, the representative of the prosecutor’s office has ordered only the expertise on the affected weapons of the police and not on the weapons of the army (which were the ones who fired). He added that the tests are being carried out 24 hours later, even more, with the argument being that the accesses to the areas are being taken over by the protesters.
The lawyer stated that it is important for investigations to have the necessary information as soon as possible. If the Public Ministry allows so much time to pass, the weapons can be handled and cleaned, just like the area where the clashes take place. He affirmed that these actions are building a mechanism that could generate impunity.
