W 2020 r. Insurance Guarantee Fund sent summons to pay the so-called additional fee, i.e. penalties for the lack of civil liability, to 199.2K people. Compared to 2019, it was an increase by as much as 58%. It is still a long way to the end of 2021, but in this matter one should not expect positive data.

– Unfortunately, we expect the negative trend from 2020 to continue. Currently, we do not yet have data on the number of people who should pay an additional fee for the lack of civil liability. Taking into account the partial data, it can be expected that by the end of 2021, this number will be at least as high as in 2020 – says Autokult.pl Damian Ziąber, UFG spokesman.

About 200,000 the punished is a disturbingly large number. Especially surprising when we hit it with the penalty for the lack of civil liability. Currently, the owner of a passenger car can pay a maximum of PLN 5,600. The amount of the additional fee, however, depends on the amount of the minimum wage, and this is set by the government each year. In 2022, it will most likely amount to PLN 3,000 gross, which also means an increase in penalties for failure OC.

In such a scenario in 2022, the owner of a passenger car will pay as much as PLN 6,000if the interruption in the continuity of the third party liability insurance policy lasts more than 14 days. If it takes 4 to 14 days, the penalty will be PLN 3,000, and if it is not longer than 3 days, you will have to pay PLN 1,200. With these amounts mandatewhich a policeman can now impose seems to be a breeze. How do you usually break your third party liability insurance policy?

The drivers don’t know the rules

It happens that some motorists are convinced that the coronavirus pandemic has suspended the obligation to pay civil liability insurance, or that you do not need to have one if you do not use the vehicle. Both statements are incorrect. Also, the policy will not always be automatically extended for another year. This will not happen if the payment for the previous one has been divided into installments, and at least one of them has not been settled. However, most of the pitfalls await those who have recently bought a used car.

After a change of owner, the third party liability insurance policy will not be extended automatically. The coverage is valid until the date indicated in the confirmation of concluding the insurance contract. Usually, because there may be exceptions to this as well. The Insurance Guarantee Fund encourages you to contact the current insurer after purchasing the car and check until when the policy is valid. It may happen that the seller (still as the owner of the vehicle) has terminated this contract and it will end before the date specified in the policy.

New owner of a used car may use the third party liability insurance policy concluded by the previous holder until its termination. He can also terminate the contract at any time and conclude a new one with another insurer.

It may also happen that a car that does not have a valid civil liability was put up for sale. What then? Of course, the new owner does not pay a penalty for neglecting the previous one. In such a case, the third party liability insurance contract should be concluded by the buyer at the latest on the date of purchase of the vehicle, but not later than before putting it into service.

Car from a commission or from abroad

What about compulsory insurance after purchase second-hand cars? In this case, on the usual terms, the policy of the current owner is used. If you ran out of this before purchasing the vehicle, the owner of the commission shop should take out a short-term policy. Short-term civil liability is concluded for a period of at least 30 days and usually the new owner will have the maximum amount of time to conclude his insurance contract. Short-term third party liability insurance is also not automatically extended for the next period.

Many people buy cars abroad directly from the current owner. The buyer has 60 days to register it in Poland if the car comes from one of the EU countries, or 30 days if it concerns other countries. If the previous owner did not deregister the car and it has valid civil liability insurance, you can use a foreign policy at that time. However, if the vehicle has been deregistered, temporary (valid for 30 days) registration plates must be obtained and short-term insurance should be purchased for this period. Then you have to conclude a standard third party liability insurance contract valid for 12 months.

Punishment from the cloud

According to the law, even cars that are inoperable and do not go on the roads must have a third party liability insurance policy. In such cases, however, some drivers do not contain it, believing that no one will find out about it. This is a mistake. You do not need a police road control to be punished for the lack of civil liability. UFG uses a computer system that compares the data on registered vehicles from the Central Vehicle Register with the data on policies concluded with individual insurers, which is flowing on an ongoing basis. The UFG program can detect irregularities very quickly, so there is no need for impunity.

The amount of the additional fee remains a problem. PLN 5,600 in 2021 and probably PLN 6,000 in 2022 are huge amounts. The punished may submit a letter for remission or reduction of the penalty. A specimen of the letter and the asset declaration necessary in such a case can be found on the UFG website (tab “I got a summons”, and then “Documents”). However, as Damian Ziąber admits, Merely referring to the state of the epidemic or the lack of knowledge about the applicable regulations may not be sufficient.
