The new rent index law has been in force for around six months. According to this, municipalities with more than 50,000 inhabitants are now subject to an obligation to compile rent indexes. With the Rent Index Ordinance, the legislator has also specified the legal area in which a legally secure rent index is to be drawn up. He thus links the expectation that future rent index preparations and their application by the parties to the rental agreement as well as the case law will be easier and stronger.
The response to the new regulations is still divided in the professional world. And in practice, too, the new legal framework continues to raise many questions regarding implementation.
