The new Penal Code brings prison for debt to the State – What the AADE circular says – 2024-03-07 10:23:20

Strict penalties for those who owe to Tax office the new Criminal Code provides, with debtors even facing a prison sentence for amounts over 100,000 euros. Avoiding a prison sentence is only possible if the debt is paid in full before the case goes to court, or is included in an installment arrangement, as noted by “Democracy”.

Now, the debts arising from the non-execution of fines imposed by the courts are also included, together with the interest surcharges, according to a circular of the AADE which clarifies the interventions in the Criminal Code and the Code of Criminal Procedure.

According to the AADE circular:

If the certified debts to the State, legal entities under public law, businesses and organizations of the wider public sector are not paid for a period longer than 4 months, a prison sentence is provided.

  • At least one yearsince the total debt from any cause, including any kind of interest or surcharges and other charges up to the date of drawing up the table of debts, exceeds the amount of 100,000 euros.
  • At least three years oldsince the overall debt exceeds the amount of 200,000 euros.

At the same time, the new Criminal Code introduces stricter penalties for offenses related to money laundering and Money laundering.

The fine remains at the levels of 50,000 euros to 10,000,000 eurosbut the fines for infringements where the profit of the infringement cannot be calculated are increased to €4,000,000 from €1,000,000.

In particular, if the criminal act of money laundering or other offenses for the benefit of a legal person or entity by a natural person who plays an administrative role in them or has authority to represent them shall be imposed:

  • Administrative fine from 50,000 euros to 10,000,000 euros.
  • Revocation or suspension of operating license or prohibition of business activity for one month to two years or dissolution of the legal person or entity.
  • Prohibition of business activities or increase of share capital for a specified period of time.
  • Exclusion from public benefits, subsidies and other public privileges for a certain period of time.

The above sanctions are also imposed when a natural person who has any of the mentioned qualities is a moral perpetrator or accomplice in the same acts.
