THE SECTION Second of the Provincial Court of Pontevedra was the scene yesterday of a most unusual trial. The accused, Fernando Chair, a lawyer with an office in Vilagarcía. The object of discussion was the 40.000 euros that the latter were required to, in 2009, get out of prison after one of his drug deals. The funds to pay the bail were deposited by Fernando Silla, who had received them from one of the accounts of Fernández Sánchez’s mother. And the disagreement came in 2017, when the National Court decided to reimburse that amount, since O Coxo had already been tried.
At that point, the lawyer (and defendant) assures that the money is his since 2009, and that it was given to him as fees on behalf of Guillermo and of Javier Janeiro, Javillo, a drug dealer even more famous than the previous one. He explained that the agreement was for 50,000 euros plus taxes, so the 40,000 would only be part of his emoluments. He further added that he decided to deposit them as surety “to build customer loyalty”, noting that it was a common practice at that time. Thus, and according to his testimony (he only answered his defense, refusing to do so before the prosecutor in the case), of misappropriation, nothing at all.
On the contrary, the complainant expressed his surprise when he received a message from the lawyer in 2017 in which he would indicate that he should already be satisfied after the good results obtained in the trial. “It is the lawyer who says” you owed me and with this I charge it “in a message,” snapped the prosecutor in her turn to report.
Faced with the positions, totally opposed, the Public ministry He decided to maintain his request for three years in prison, in addition to fines and compensation, for the lawyer with an office in Vilagarcía. The prosecutor assured that the presumption of innocence was completely enervated by the taking of evidence, expressly indicating that there is no way of acting defended by the investigated by any lawyer. He also indicated that the practice of collecting through bonds is not endorsed by any jurisprudence. On the contrary, Silla’s defense indicated that “it is a mechanism that is carried out, since it serves as a guarantee.”
The testimony of Guillermo’s mother, person who once contributed the funds, issued in 2018. The woman, now deceased, confirmed in the Investigation phase that she withdrew the 40,000 euros from her account and gave it to Silla for the payment of the bail of her son, thus managing to get out of prison.
The defendant added that “I had those funds in 2009, not in 2017,” alluding to the alleged pact reached by him and the drug traffickers.
The complainant is well known to anti-drug of the Civil Guard and the National Police. He was detained on several occasions.
