The Mitsotakis government is trying to block the work of the European Prosecutor in our country with a “planter” provision in the bill with the new judicial charter of the country (article 39).

Specifically, it is a provision that modifies the procedure by which the European Public Prosecutor acts, when misdemeanors that are prosecuted independently arise during the investigation. All this while the European Prosecutor, Laura Kovesi, who deals thoroughly with the 717 convention and the crime of Tempe, had stated on March 14, speaking to the STAR that: “They are blocking us from finding the truth. They block us from doing justice. Because if you are forbidden to do research, you cannot reveal the truth.”

In particular, paragraphs in paragraph 2 of article 16B of Law 4786/2021 are repealed, so the plea of ​​the accused for this type of misdemeanor will no longer be made to the European Prosecutor but to the investigator, as is done for felonies and related misdemeanors .

At the same time, in the explanatory report, it is stated that the abolition of the paragraphs was deemed necessary because they introduced “a way of referring the misdemeanors of the competence of the European Public Prosecutor’s Office that are prosecuted independently, which is not even provided for by Regulation (EU) 2017/1939 of the Council of 12 October 2017″. But also why the application of these verses in practice is expected “to cause significant delays in the speed of administration of justice”.

It is even characteristic that this article in the bill was locked in the public consultation, so that it cannot be commented on, not only by citizens of course, but also by lawyers.

It is also worth noting that breach of ministerial duty is a misdemeanor that is prosecuted independently.
