According to the ministry, the Teplice prison violated the law in connection with allowing the convicted Rath civilian clothes and a medical mattress. “At the time of the inspection by the supervisory public prosecutor, it was not possible to trace in the convict’s personal file his application for permission to hold and use civilian clothes and medical mattresses in prison or a decision on this application,” the office stated.

At the same time, however, the ministry concluded that prison staff did not favor Rath’s position at the expense of other prisoners. “Equal access to the same rights of all convicts has been maintained. For this reason, it was not necessary to take other adequate measures in relation to the Prison Service of the Czech Republic, “she wrote.

The Office also stated that the public prosecutor from the Prague High Public Prosecutor’s Office erred because she deviated from her authority and intervened in the supervisory examination of Rath’s imprisonment, which was carried out by the Ústí nad Labem Regional Public Prosecutor’s Office. “The Chief Public Prosecutor was therefore asked that the public prosecutors act in accordance with the law when exercising their supervisory competencies,” the ministry stated.

He has been sitting since October

Minister Marie Benešová (for YES) also asked the Supreme Public Prosecutor to unify the procedure of the two high public prosecutor’s offices in supervising regional public prosecutor’s offices that supervise compliance with legal regulations in prisons.

The Ministry added that it was investigating the case on the basis of Bradáčová’s initiative, which turned to the office in January this year with two letters.

Last year, Rath heard a final sentence of seven years in prison in the first branch of the corruption case. Justice found him guilty of influencing the tender for the reconstruction of Buštěhrad Castle in the Kladno region. This year, the Central Bohemian Regional Court found the former governor guilty in the second part of the case as well. For accepting bribes and manipulated public contracts of the region and regional hospitals, he extended his original sentence by one year.

Rath entered the Teplice prison in October, later he was transferred to Ruzyně. The Prison Service has previously stated that the Teplice Prison did not violate the law by allowing civilian clothes and its own mattresses, and that it had erred only in the administration of the so-called permit, which it did not properly file in Rath’s file.
