Currently, it is possible for people serving a sentence in prison to change their surname, but only if they marry and take their spouse’s surname. Therefore, despite the general prohibition, it is possible to change the surname in some cases. TM believes that the current legal system does not create a basis for a consistent approach and equal treatment.
The Ministry confirms that the mutual integration of state records (state information systems) allows obtaining information about a person’s criminal record in the cases provided for in the regulatory acts, even if the person has change name or surname. Also if the name and surname are changed according to the law, information about the change of name and surname of a person is included in the Register of Natural Persons and ensures the continuity of the identity of the person.
The information collected by the Ministry of Justice shows that the name and surname of a person who is punished can also change in, for example, Estonia, Lithuania, Finland, Portugal, Slovakia, Spain, Germany, Croatia.
