The BUMN Ministry opened its voice over the tax dispute that dragged PT Perusahaan Gas Negara Tbk (PGAS) or PGN. Regarding this dispute, PGAS has the potential to pay Rp 3.06 trillion.
Special Staff to the Minister of BUMN, Arya Sinulingga, explained that this tax problem has actually occurred since 2012. He said the company had won this dispute in the Tax Court. However, the Directorate General of Taxes (DGT) conducted a reconsideration (PK) to the Supreme Court (MA) and the situation reversed.
“This is a tax case in 2012, when they won at the Tax Court, but there is a provision that friends from Finance must enter into PK, that’s the stipulation. So when the PK, MA decided that it won,” said Arya to the media crew, Monday (4/1/2021).
However, Arya said, actually there has been a regulation from the Director of Tax Regulations which states that the object is not a tax object. Arya said, this has been recognized around 2014 to 2017.
“But previously there was also a regulation issued by the director of tax regulations that the tax object was not actually a tax object. They have acknowledged this around 2014 to 2017,” he said.
Over condition PGAS Arya said that his party would take two steps. First, his party will hold talks with the Ministry of Finance on the dispute. Moreover, said Arya, they have acknowledged that the object is not a tax object.
“Second, we will also later see how many similar cases are in the name of the verdict. Later on the basis of this decision, we will ask PGN to take more legal steps, for example the PK2 legal steps will be named later, and that is possible because it has already been done. it is acknowledged that this is not a tax object, “he explained.
Arya said that the object was not a tax object because PGN did not collect taxes on consumers who bought the gas.
“Why is it not an object of tax? Because so far PGN has not collected taxes on consumers who buy the gas. If, for example, PGN quoted taxes from its consumers, it did not pay the state for the taxes, perhaps PGN was wrong,” he explained.
“So this is not a matter of paying taxes, yes, but a matter of whether the object is taxed or not. So we are optimistic that this can be done and will not make PGN (PGAS) Please lose it because there are steps that we are taking and we are sure that the Ministry of Finance will also support us for this, “he continued.
