The election of the chief prosecutor and the president of the Supreme Administrative Court (SAC) are procedures that must continue, because it is not right for heads of bodies to be with expired mandates and to rule temporarily. Once the Constitution allows, this procedure must be followed. This was stated by the Minister of Justice Maria Pavlova before the meeting of the plenary session of the Supreme Judicial Council.

Whether the president will not sign a decree appointing the chief prosecutor and the chairman of the Supreme Court is something we will see in January or March, she pointed out and added that, as for the chief prosecutor, she will not propose a candidacy for the president of the Supreme Court.

The National Assembly in the last two years did not even adopt rules for the election and did not show an elementary desire to start this procedure. The election of already elected members of the magistrate quota was even cancelled, Pavlova said.

The Judicial College of the Supreme Judicial Council adopted a schedule for conducting the procedure for the election of the President of the Supreme Administrative Court (SAC), according to which the election should take place on March 20. The Plenum of the SJC is yet to approve the proposed schedule. In four consecutive meetings of the SJC Plenum, there will be an opportunity to submit candidacies.

The mandate of the current chairman of the SAC, Georgi Cholakov, expires at the end of November.

Currently, the procedure for the election of the chief prosecutor is underway, where the only candidate is Borislav Sarafov. The election is scheduled to take place on January 16.
