A verdict was also reached in the third instance in the lawsuit that has been going on for years, which He Andrethe director of the Median public opinion poll, started it Elk*rtukat producer Megafilm Kft. production company and Gábor Kalomista against the producer, alleging that the film violated his personal right to protect his reputation: despite the fact that in the first instance they still ruled in favor of Hann, in the second instance last spring Kálomista was right, and now the Court has also decided, confirming the judgment of the second instance court, thereby the case is also closed.
The defendant’s film is a feature-length film, and it is obvious to the average informed viewer that in such films the real events are not repeated with the actors playing, but rather the work is a visual and audio reproduction of the creators’ imagination. (…) The actions in the film do not depict the private sphere of the plaintiff – who is also protected as a public figure – but show the activities of a fictitious public opinion pollster and related political consultant.

The lawsuit was started because it shaped the events of the fall of 2006 into a thriller Elk*rtukIn , the figure of the director of the Median public opinion poll also appeared, as a serious political background figure. Hann called the film and its promotional campaign, which named him, a defamation, and even then put legal action in perspective, if Kálomista does not publicly apologize and pay compensation within the framework of an out-of-court settlement. Since the producer was not willing to do so, Hann sued the producer Megafilm.
One of the film’s producers, Gábor Kálomista, called the Court’s verdict a precedent.
The verdict means that the freedom of filmmaking and art in general is ensured in Hungary. Of course, it is possible to argue about how a work should be interpreted, but we cannot get to the point of banning a film or threatening the creators with compensation based on feelings of grievance. I am glad that the Court saw the sanity of the court of second instance as correct
