The List of Malicious Landlords Causing Trillions in Damage to Housing and Urban Guarantee Corporation (HUG)

The total amount of guarantee accidents reported to the Korea Housing and Urban Guarantee Corporation due to malicious landlords failing to return the deposit on time was calculated to amount to KRW 1.6553 trillion.

According to the Ministry of Land, Infrastructure and Transport on the 28th, the revised Private Rental Housing Special Act and the Housing and Urban Fund Act, which contain the legal basis for disclosing the list of malicious landlords, will come into effect on the 29th. As related laws come into effect, it is expected that the list of malicious landlords will be made public as early as this year.

The standard for disclosing the list is that the number of indemnification debts claimed by the Korea Housing and Urban Guarantee Corporation, which operates a deposit return guarantee insurance, after returning the deposit to the tenant, is at least 2 within the past 3 years (including 1 case after the enforcement of the law) and the amount is 2. It is more than a billion won. Even if more than 6 months have passed since registration as a rental business was canceled due to failure to return the deposit on time, if more than 100 million won of unreturned deposit remains, it will also be disclosed.

The final decision on the list of subjects to be disclosed will be made by the Landlord Information Disclosure Deliberation Committee after going through the explanation process of the parties. The names of malicious landlords that the Information Disclosure Committee has decided to disclose will be revealed on the websites of the Ministry of Land, Infrastructure and Transport and the Korea Housing and Urban Guarantee Corporation and the Safe Rental App.

If an exception occurs, such as the death of the lessor, it is excluded from disclosure. If an exception occurs after the list is released, it will be deleted.

The Housing and Urban Guarantee Corporation is managing those who have lost contact with landlords who have repaid the deposit three or more times or who have not paid a single penny of the guaranteed debt in the past year as multi-home debtors under intensive management. These people were classified as malicious landlords who habitually failed to return tenants’ rental deposits.

According to data submitted by the National Housing and Urban Guarantee Corporation to Rep. Maeng Seong-gyu of the Democratic Party of Korea, a member of the Land, Infrastructure and Transport Committee of the National Assembly, the number of multi-home borrowers under intensive management by the Korea Housing and Urban Guarantee Corporation is 334 as of the end of June this year. As of the end of last year, there were 233 people, but the number increased by 101 in 6 months.

As these 334 people did not return their deposit on time, the total amount of guaranteed accidents reported to the Housing and Urban Guarantee Corporation was KRW 1.6553 trillion. Among these, the total rent (subrogation amount) returned by the Korea Housing and Urban Guarantee Corporation to tenants is KRW 1.4665 trillion.

According to the Housing and Urban Guarantee Corporation, most warranty accidents occurred in multi-family homes in the first half of this year. Of the 2,443 guaranteed accidents, 1,198, or 49%, occurred in multi-family homes, amounting to 214.7 billion won.

There were 1,056 officetel warranty accidents, accounting for 43% of the number of cases. The amount was 225.3 billion won, which was more than that of multi-family housing.

Apartment warranty accidents are also increasing. The number of apartment warranty accidents increased from 42 in 2019 to 152 in 2020, 251 in 2021, and 211 in 2022, and 145 in the first half of this year.
