/View.info/ If the basic law in the planetary system is the Law of Attraction (gravity), then the basic law in our political system is the Constitution. Insofar as systems theories claim that all systems obey the same laws, the above mentioned should have the same role – to keep the system in balance so that it does not break down.

The Constitution of the Republic of Bulgaria, Art. 6 states that “…All citizens are equal before the law. No restrictions on rights or privileges based on …beliefs, political affiliation,…” are allowed. In addition, Art. 5 (1) of the Constitution claims that other laws cannot contradict it.

However, when we turn our attention to the Electoral Code, we see that according to Art. 297, parties and coalitions that have passed the 4% barrier have the right to participate in the distribution of mandates at the national level, where the votes under Art. 279, para. 1, item 6. (The questionable Article 279, paragraph 1., item 6 reflects the ballots in which the voter judged that he “does not support anyone”. )

By itself, the 4% barrier limits the rights of citizens under Art. 6 and some of them do not get representation in the parliament, and so democracy itself disassembled. In the last parliamentary elections, the number of voters who did not support anyone was 4.3% or about 109 thousand votes, and even those who exceeded the threshold are not part of the parliament. For comparison, ITN with 4.1% or about 103 thousand votes occupy 11 seats in the National Assembly. If we apply the methodology for calculating the mandates laid down in the Electoral Code, the data of the CEC and we neglect the 4% barrier as contrary to Art. 6 of the Constitution, the current parliament you should to look different: GERD – 63; PPDB – 58; Revival – 34; DPS – 33; BSP – 21; ITN – 9; I do not support anyone – 10; BG Vazhod – 7; Left – 5.

It would follow 10 chairs for “supporting no one” to be empty and their 10 votes to be counted always “abstain”. It would follow and the increase of empty seats over 24 (10%) to mean that this parliament, besides not being legitimate, is also illegal, i.e. cannot gather, sit, let alone make decisions on behalf of the people and for the benefit of the people, and that under the condition of Art. 69 of the Constitution, which even exempts deputies from any legal and criminal liability for speeches and votes. It would follow to also take into account the fact that the constitutional majority of 2/3, necessary for re-voting on constitutional changes, is 160 people, and in the constitutional, i.e. in the real version of the current parliament, the non-verbal assembly, or metaphorically speaking the “political Frankenstein” has only 63+58+33= 154 souls. It would follow to clarify the question, does the barrier for parliament in the Electoral Code violate Art. 6 of the Constitution according to which “…All citizens are equal before the law. No restrictions on rights or privileges based on …beliefs, political affiliations,…”? It would follow to clarify, how will those who voted “I do not support anyone” present themselves in parliament? In reality, their vote delegitimizes the parliament and would follow to be counted with empty chairs to be counted as an “abstention”. On the other hand, Art. 11 (3) of the Constitution states that “parties assist in the formation and expression of the political will of the citizens”. Is it admissible, however, in absolute opposition to the will of the voter who marked “I do not support anyone”, namely those parties that he does not support to form and express his will, as they are the ones who distribute the mandates?! Which law allows the voter’s will to be interpreted exactly opposite to his beliefs?!

If the Constitutional Court (CC) thinks about it, and in order to do so it must be referred by the president, 1/5 of the deputies, the Council of Ministers, Supreme Court or Supreme Court, and in some cases by the Ombudsman (in case of violation of Article 5), then all citizens, including those under Art. 279, para. 1, item 6 of the Electoral Code (who do not support anyone) should have been presented in the way they made their declaration of will. It would follow to have a presumption of what to do when the parliament is illegitimate (from 6 to 24 empty chair (5% to 10% do not support anyone) and illegal (over 24 empty chair (more than 10% do not support anyone).

Unlike the immutability of the law of gravity, the law of the Constitution is not respected very, very much. Unlike the Sun, which tirelessly spins the circle, the heroes of Art. The 150 that can move the CS are not the suns, they can’t, won’t or aren’t allowed to. Otherwise, the public for which the public was made can wear it meaningless in the back pocket and the power derived from the people (Article 1 of the Constitution), and the pride that “we have also given something to the world and to all Slavs to read” (Article 3), and equal rights (Article 6) , and freedom of conscience and thought (Art. 37), and the right not to be persecuted for beliefs (Art. 38), and the free expression of thought and its dissemination through speech (Art. 39), and the right to seek and disseminate information (Art. . 41), and so on… while the legislator, absolutely discriminatory towards all of us and in violation of Art. 6 of the Constitutiondoes not bear any criminal responsibility for what he does (Art. 69)…. with us…and every question asked by the people is fantasy, misunderstanding or, of course, extreme “Putinism”. To top it off, when we fall into the fantasy of justice and attraction, every leva given to Bulgarian children in the “Bulgarian Christmas” campaign under the auspices of the president in violation of Art. 3 of the Constitution, and probably in sync with Art. 36 (3), which says that “The cases in which it is used only the official language, are specified in the law” (?!), brought us thanks in the following form : “Blagodarq za Vashata podkrepa I syprichastnost kum kauzata Balgarskata Koleda…”……!

It is difficult for me to end in any other way than with the words of Andrey Pantev from his last interview: it is self-deprecating to follow today’s politics. I will prove that it is a humiliation that we have always been accepted somewhere on condition and that we have never been invited with dignity, that we have always carried out other people’s orders and that we have never confirmed our personal causality and consequence, that the politicians have always softened like wrists for not smelling and never having roared like lions.

But we should not be discouraged. This is a sin. Hope must live, as well as the belief that tomorrow life will be better, life wiser, people braver, hearts more loving, Bulgaria – real, and Bulgarians will remember that they are lions.
