Six teachers from the Louis-Pasteur elementary school in Saint-Denis (Seine-Saint-Denis) objected to the forced transfer from the rectorate in the name of “the interest of the service”.
The interim judge of the Montreuil Administrative Court found the arguments opposed by teachers at the Louis-Pasteur school unfounded, in a decision on Wednesday.
The intention of the rectorate of the Academy of Créteil was not to “sanction” ni de “request” their trade union commitment, but to act in front of “climate degradation” within the establishment, he therefore considered.
These six teachers, five women and one man, had filed a summary release (urgent procedure) together with the Sud Education 93 and SNUipp-FSU 93 trade unions, as well as the students’ parents, to challenge the transfer which took effect on Monday.
The judge also found that “the best interests of the child” were respected because substitute teachers were assigned in the affected classes.
The transferred teachers had expressed their fears in the face of a sudden break with the students, some of them in great difficulty or handicapped.
It emerges from an administrative survey conducted from November 2021 to March 2022 on the functioning of this REP + classified institution, which welcomes around 300 students.
The arrival of an ephemeral director last September had deteriorated relations with the team, according to the teachers’ account. Then an article on “left in school”, published in January in the conservative magazine Incorrect, set the gunpowder on fire. The director, who testified anonymously, then left the establishment.
National Education criticizes teachers in particular “systematic position of opposition”try to impose “a framework of self-management” or “a manipulative attitude”.
This is’“accusations” without foundation or proof, according to the teachers, that they are in “misunderstanding” file in front “video” of evidence.
Their lawyer Me Arié Alimi indicated that his clients were considering a possible appeal against this decision before the State Council.
