According to the facts, the security agent of the aforementioned train station, Juan Noé Neyra Sagua, observed that three (03) male people, including the accused Ignacio Andrés Amunátegui Halyburton, were spraying graffiti on two of the stations. cars of the electric train No. 10, specifically the figure of a “dog” and the letters “OVN”, for which they entered the restricted area of the train rails, thus hindering the normal operation of the public transport service provided by this electric train of the Lima Metro.
Given this, he proceeded to try to apprehend these people; However, they ran to the emergency door, where two of them managed to escape, the same did not happen with the accused, who was managed to subdue with the support of two other agents and a supervisor, who was present at the scene. .
Magistrate Mayta Palián convicted the Chilean citizen as the author of the crime Against Public Security – Crimes against the means of transportation, communication and other public services – Hindering the operation of public services, to the detriment of the State.
And as such, he imposed three years and four months of imprisonment, suspended in its execution for a period of three years; subject to the following rules of conduct:
- Establish an address in our territory or, failing that, carry out the corresponding procedure with the Consulate of Chile in our country, so that notifications are channeled through its intermediary (virtual or official channel), which must be reported within a period of time. maximum of 10 days from the issuance of this resolution; under the warning of notifying the addresses recorded in the records or by the legal procedures established in our country.
- Do not commit a new intentional crime.
- Comply with the payment of civil reparation and fine days in the agreed manner and manner; all this under the warning of applying paragraph 3) of article 59 of the Penal Code, in case of non-compliance with the aforementioned rules of conduct, following a tax requirement.
