The Judiciary rejected habeas corpus of a foreign citizen who intended to enter Peru without a visa

Given the official pronouncement of the Judiciary and the Review Commission for Refugee Affairs, denying in all its aspects what was requested, Duiliana Sánchez Pereira proceeded to re-embark her free of charge, destined for her country of origin.

The Judiciary, through the 8th Preparatory Investigation Court of the Superior Court of Justice of Callao, declared unfounded the habeas corpus claim filed by Luis Gonzales Delgado in favor of the Venezuelan citizen Duiliana Sánchez Pereira and against the Callao Zonal Headquarters of the National Superintendency of Migration.

The foreigner, Sánchez Pereira, was denied entry to Peru on January 31, for having an expired residence permit and not having a visa. Despite her refusal, she remained of her own free will in the international transit area of ​​the Jorge Chávez International Airport awaiting the ruling of the Judiciary, regarding habeas corpus, as well as the decision of the Special Commission for Refugees, in relation to her request for refuge.

During 2023, Migrations has denied entry to Peru, through the Jorge Chávez International Airport, to more than 660 foreigners of various nationalities who did not have the required visa, in compliance with reciprocity and immigration security policies.

These people must return to their place of origin for free through the airline that brought them and can return to Peru once they meet the entry requirements. Immigration also sanctions airlines that bring passengers who do not comply with entry requirements, such as visa requirements, where applicable, with a fine.
