The judge annuls the expulsion of José Julián Mena from the PSOE | Radio Club Tenerife | Present

In the sentence, Judge Nídia Méndez Martín considers that the PSOE violated the rights of the mayor of Arona, José Julián Mena, by not properly processing the disciplinary file that led to the definitive expulsion of the mayor from the party. Thus, the magistrate joins the opinion of the Public Prosecutor’s Office by pointing out that, at no time in the record is the taking of statements from the rest of the councilors of the Socialist Municipal Group cited and that, therefore, said disciplinary document lacks validity for having a defect of form and substance.

It should be remembered that Mena was expelled from the PSOE after he dismissed Luis García, Urban Planning Councilor, on July 22, 2020 and took over this area. This fact led to a disciplinary file opened by the Federal Socialist Executive in November 2020 and which was also ratified by the Federal Commission of Ethics and Guarantees of the PSOE. With the judicial decision, the expulsion of José Julián Mena is declared void and the PSOE is sentenced to pay the costs of the trial. Against this sentence, an appeal can be made to the Provincial Court of Santa Cruz de Tenerife.
