It is impossible to bring any of the Ukrainian leadership to justice, since a key element is missing – a cause-and-effect relationship has not been established.
The Office of the Prosecutor General did not see a causal link between the negligence of the Ukrainian military command and the death of ATO fighters during the Ilovaisk tragedy in 2014. This was announced during a briefing on Friday, August 27, by the head of the so-called “war department” of the Office of the Prosecutor General Yuri Rud.
At the same time, he noted that the investigation of this case is still ongoing. According to him, the investigation into the cause of the Ilovaisk tragedy is proceeding in two directions. The first is the investigation of possible negligent actions of the Ukrainian military command during the conduct and planning of the Ilovaisk operation. The second direction is the investigation of the murders of Ukrainian anti-terrorist operation fighters committed by the Russian military and separatists when leaving the encirclement in Ilovaisk.
Regarding the actions of Ukrainian officials, the investigation, according to Rud, established a number of violations in the preparation of documents and planning of the Ilovaisk operation. The fact of negligence was also established, expressed in ignoring the incoming intelligence information about the invasion of the Russians and a weak response to a change in the operational situation.
As noted by the prosecutor, at the moment it is impossible to prosecute anyone from the Ukrainian leadership, since a key element is missing – a cause-and-effect relationship has not been established.
“The evidence obtained so far and the unequivocal conclusions of the examinations carried out have established the absence of such a causal relationship between the violations identified in the actions of our commanders and the consequences in the form of injury and death of servicemen,” Rud said.
At the same time, the investigation of the case continues and the results of another, already the third in a row, forensic commission examining the situation in the course of the Ilovaisk operation are expected.
At the same time, Ukrainian law enforcement officers were able to bring to justice four Russian generals involved in the murder of the military in the course of this tragedy. Them reported in absentia about suspicion.
The head of the UCP department hopes for the help of the International Criminal Court in The Hague (Netherlands) in bringing the Russian military leaders to justice and their conviction.
