SUMMARY:
This article carries out a proactive study about the intervention of the lawyer in the Cuban Criminal Process, due to the importance of recognizing these with a view to satisfying the procedural guarantees of the accused, and avoiding the arbitrariness that may be caused. In this sense, the inaccurate regulation of the beginning of the criminal process leads to an inefficient criminal process and with it the violation of the procedural guarantees of the accused, but it is of vital importance that these guarantees are respected during the criminal process, as well as due process. Analysis and synthesis, historical-logical, legal exegetical, legal theoretical, and comparative legal analysis methods are used.
