The Importance of Adding an Incapacity Clause to Police Officers’ Occupational Disability Insurance

Occupational and service incapacity are terms that are often equated but have fundamentally different meanings. If you choose the wrong insurance, this can have serious consequences in an emergency.

What does occupational disability mean?

Occupational disability is a term that is relevant to occupational disability insurance. It is diagnosed by a doctor. The doctor must issue a certificate that contains the specific activity and the extent to which it can no longer be completed. As soon as the proportion is more than 50 percent, and for at least six months, the patient is considered unfit for work and the insurer must pay the contractually agreed amount.

What does incapacity mean?

Only civil servants can become incapacitated. In contrast to occupational disability, there is no limit to what proportion of work can no longer be carried out. As soon as the medical officer determines that you are unable to work, disability insurance pays out. This can also be the case if only a small but significant part of the tasks are affected.

What civil servants should pay attention to

It is important that a civil servant’s occupational disability insurance contains an incapacity for work clause. This may mean that the service can be accessed much earlier.

In addition, for some professional groups there are special skills that are covered by disability insurance. In the case of police officers, this affects the so-called shooting finger. A police officer who is no longer able to shoot can no longer carry out only a small but significant part of his or her duties and is therefore often transferred to internal service.

Another example are firefighters who can no longer walk properly due to a physical limitation and are unable to fully perform their fire service duties. If they can no longer complete 24-hour shifts, they will probably be used in administration instead. With appropriate coverage in the disability insurance, in both cases the transfer is sufficient for benefits to be paid out.
