Over the last year, the use of music generated by artificial intelligence (AI) on social networks has become more frequent; some artists have even spoken out about this situation, such as the singer Bad Bunny.

The night of this November 6, through his WhatsApp channel, Bad Bunny called on his followers after the song ‘Nostalgia (RMX)’ that uses an imitation of his voice and that of the artist Bad Gyal.

“If you like that shitty song that’s viral on TikTok, get out of this group right now,” wrote the ‘Bad Rabbit’.

Like Bad Bunny, other artists, such as the SAG-AFTRA actors union strike in Hollywood, have spoken out against the use of AI for the creation of content such as songs. Have you wondered if these creations are copyrighted?

How are songs made with AI?

Currently there are various applications that use artificial intelligence with which musical pieces can be generated.

Some of these applications only need a description of the single you are looking to create and a ‘sample’ of the type of sound you are looking to replicate. This is what Holly Herndon, a specialist in the subject of music created by AI, said in an email to The New York Times:

“It is now possible to produce infinite media in someone else’s style or likeness, soon with little effort, so we all have to come to terms with what that means.”

Bad Bunny has not been the only artist from whom they have taken their voice. According to Variety, in April a song created by artificial intelligence called ‘Heart on My Sleeve’ went viral in which the voices of singers Drake and The Weeknd sound; However, none of these celebrities have collaborated on any single.

Although these artists have complained about the situation of AI in the music industry, there are those who have taken advantage of this tool to produce new singles. Like the singer Paul McCartney, who released a new song by The Beatles in which his deceased colleagues such as John Lennon sound through artificial intelligence.

What about copyrights and songs made with artificial intelligence?

The National Autonomous University of Mexico (UNAM), copyright is those rights granted to the authors of works such as books, songs, photographs, audiovisual material, among others.

The issue of songs made with artificial intelligence has created a debate about how copyright works, since some pieces use the voices of deceased artists or those who have not signed any type of contract.

There are controversies such as the case of the song ‘Heart on My Sleeve’ that was submitted for consideration at the Grammy Awards.

According to a publication in The New York Times from April of this year, at the moment only the work of a human being can be protected by copyright. In the case of compositions made with artificial intelligence, it continues to be a work in progress.

In conversation with the Harvard Law School site, lawyer Louis Tompros explained that the situation with material made with AI generates an impact in two categories:

“I think about the impact of AI on copyright in two categories. One is the rights that the AI-generated material itself has, and the second is the rights that someone can assert against the AI-generated material.”

Tompros assured that changes must be made in the way copyright is understood with pieces made with artificial intelligence: “I hope it will be clarified whether an AI work that follows the style of another is or is not a derivative work.”
