Isabelle * (45 years old) was for more than eight months, from May 2019 to January 2020, Robert * ‘s housekeeper, in Caen. Aged 90, the old man suffers from near blindness due to MDLA (degradation of the retina). Sent by an association, she did a few hours of cleaning per week and then “on a voluntary basis, outside of her working hours, food shopping to help her”. To do this, Robert gave him his card.
It will be the daughters of the nonagenarian, alerted by the absence of bank statements, normally received by post, who will notice unexplained withdrawals from their father’s account. Tuesday 1is June 2021, Isabelle appeared in correctional for these facts of breach of trust.
Minimum recognized facts
From the start of the employee’s intervention at Robert, in May 2019, reckless bank withdrawals were made. Expenses correspond to purchases of women’s clothing in stores in the Rives de l’Orne shopping center. This every month until January 2020. Every month, except the month when Isabelle was on vacation.
As it was she who brought the mail, she took the opportunity to steal the bank statements. Isabelle admits “loans” that she estimates at 2,350 euros that she has also repaid because “it made her sick”. In just 8 months, nearly 6,000 euros have been embezzled. “Others than me came to see him and used his card, I only took a little,” she objected to the bar. This scandalizes the lawyer for the civil party: “You are minimizing! You have profited without any scruple from his handicap and his great age, it is unacceptable! Take your responsibilities! “.
The prosecutor still welcomes the compensation, which is not always the case in this kind of abuse:
This work is not done by people who ride gold, and the temptation can be great. But even if the defendant’s locker is blank, once is once too many!
Isabelle receives a 4-month suspended prison sentence required by the prosecution, 1,500 euros in material damage, 500 euros in moral damage and 850 euros in costs.
