“The highest figure known so far”: cases and complaints of homophobia and transphobia increase by 14.7% in Chile

Data collected by the XIX Annual Report on Human Rights of Sexual and Gender Diversity prepared by the Movement for Homosexual Integration and Liberation (Movilh), reported a 14.7% increase in cases and complaints of homophobia and transphobia in Chile in 2020, adding 1,266 cases, that is, “the highest figure known so far and which accounts for 22.9% of all abuses that occurred in 19 years.”

The number of violations of the law are divided into “6 murders, 132 physical or verbal attacks perpetrated by civilians, 16 police abuses, 110 cases of employment discrimination and 33 of an educational nature.” In addition, “60 mobilizations or hate campaigns, 379 episodes of institutional marginalization, 64 exclusions in the public or private space, 253 cases of community homo / transphobia (“ family, friends, neighbors ”), 209 discourses that incite to violence and 4 acts of discrimination in culture, media or entertainment ”.

Likewise, the report revealed that “homo / transphobic statements” increased 208%. On the other hand, that “marginalization in public or private spaces” increased by 106.4%, “hate mobilizations” by 93.5%. Similarly, “physical or verbal attacks perpetrated by civilians” in 80.8%, “community discrimination” in 51.4%, employment discrimination in 50% and finally, murders in 20%.

The breakdown of the total known abuses in 2020 affected “26% affected gays, 15% lesbians and 11% trans (76 women and 59 men), while 48% affected the LGBTIQ + population as a whole” .

Compared to 2019, “discrimination against gays increased by 78.4%, to trans by 46.8% and to lesbians by 8.28%, while abuses against the LGBTI + population as a whole decreased by 6.26%” .

Regarding the geographical distribution of abuses, Valparaíso registered the highest concentration with 38.4% of the national total. In second place, the Metropolitan region with 23.9% and in third place the Biobío region with 3%.

Specific sectors of the Government and municipalities make some progress possible

From the entity they point out that “although the Government was weak in terms of public condemnation of the human rights violations of LGBTIQ + people, it kept human rights defenders in distress, it refused to implement public policies focused on the In the context of Covid-19, it was indifferent to homophobic abuses within the Navy and made a permanent lobby in the National Congress to boycott legal equality, some departments experienced progress ”.

It is in this sense that the legal and psychological support that the Undersecretariat for Crime Prevention provided to the victims of homo / transphobia stand out. In addition, “a greater coordination of the Health Seremis with the LGBTIQ + movements was added to confront HIV / AIDS.” In parallel, the Ministry of Health created the Department of Human Rights and Gender and for its part, “Gendarmerie approved a protocol that summarizes the rights of inmates, visitors and trans civil servants established in the law and in rulings that condemned the the entity”.

Likewise, the Department of Migration and Foreigners launched a circular to protect the rights of transgender people and for its part, the Ministry of Housing and Urbanism (Minvu) allows same-sex couples to apply for housing subsidies.

In a special way, the report highlights the milestone where the Intendancy of Social Security and Health Insurance Funds forced Isapre Vida Tres to “grant assisted fertilization coverage to a lesbian couple, after refusing to do so for homophobic reasons.”
