The daughters of the Soviet film director and writer Vasily Shukshin presented their claims to the theater of Nadezhda Georgievna “Russian Song”. The basis for the trial was the violated copyright of the heirs.
It was about “Kalina Krasnaya” – a story written by Shukshin himself. He composed it in a short time in the hospital, where he landed after disputes with the artistic council of the film studio. Vasily Makarovich wanted to make a film about Stepan Razin, but officials insisted on a film about Soviet reality. And so “Kalina Krasnaya” was born. By the way, the name was invented by Lydia Fedoseeva-Shukshina, the wife of the director, who was the first to read the story.
And now the work has caused a conflict between the theater and the heirs of the writer. Unfortunately, the problem could not be solved without the participation of the court. And the descendants of the film director – Olga and Ekaterina Vasilievna – filed a claim. They managed to punish “Russian Song” in the amount of more than 600,000, declaring a violation of their exclusive copyright in the story.
According to Ekaterina and Olga, the box office had no legal grounds to sell tickets for Kalina Krasnaya. The fact is that Nadezhda Babkina’s license for the commercial exploitation of this work has ended. However, the production was not removed from the repertoire.
The representative of the writer’s heirs insisted on compensation for 8 performances, most of which took place on the territory of the Russian Federation. As a result, the court protected the interests of the heirs of Vasily Shukshin – and imposed a monetary penalty on the violator in favor of the sisters: Olga will now receive more than 250 thousand, Ekaterina – more than 380 thousand rubles.
As for the future fate of the theatrical performance, the decision to ban it has not yet been taken by the court. Moreover, the youngest of the daughters of Vasily Makarovich, Maria Shukshina, is now playing in Kalina Krasnaya.
