The Government will continue to extend the social shield due to the pandemic, with the approval this Tuesday in the Council of Ministers of a moratorium on the payment of mortgages and consumer loans. As this newspaper has learned, the duration of the payment deferral for families affected by the pandemic will be a minimum of three months from its grant and a maximum of nine. Sequentially, since the first three months correspond to the legal moratorium and the additional six to the banking sector moratorium. The measure has been negotiated until this Monday by PSOE and United We Can, which they maintained differences regarding the terms.
Some 600,000 families have benefited from these moratoriums since the start of the coronavirus pandemic. On the other hand, it has been agreed among the members of the Executive that the beneficiaries of the moratoriums on consumer loans who were able to request them in the previous extension -until September 29- are not affected by the new regulation. They will thus maintain the same regime applied until now as there is no retroactivity. In the last text approved on mortgage moratoriums, it was required to benefit from this aid to allocate more than 35% to the payment of the mortgage and supplies and a monthly rent below 1,613 euros.
The last Council of Ministers approved the extension of the ERTE until May 31, as well as the rental contracts and the deferrals or debt restructuring for tenants of homes owned by large holders or public entities until May 9, coinciding with the end of the alarm state. The extension of the habitual residence lease contracts has been established for a period of four months, with the same conditions as the current ones. The extension of the period for requesting the moratorium on rent payment, on the other hand, is limited to cases in which a large holder or a public company is the lessor. The period of temporary and extraordinary deferral in the payment of rent for these cases is the same as in that of contracts.
To these measures are added the decrees approved in December to paralyze the deshauicios vulnerable families with no alternative housing and prohibit cuts in basic supplies. The novelty that was introduced is that in order to carry out the launches it will be mandatory for the social services to previously make a report, of a binding nature, to discern the vulnerability condition of the affected people. The courts must request it on a mandatory basis whenever those affected claim to be in a situation of vulnerability. The text also incorporated economic compensation to the owners to avoid lawsuits for property damage, as long as the economic damage is proven and if the relocation does not take place within a period of three months, so the owners who have empty homes would be left out.
Last December, the Government already approved until May 31 the possibility of requesting loans guaranteed and subsidized by the State, through the Official Credit Institute (ICO), so that those economically affected by the covid-19 can do against the payment of the rent of your home.
Covid, occupational disease
Apart from the social shield, PSOE and United We can remain stuck in the negotiations for the future housing law, with which it is intended to curb the rent increases and regulate evictions. The development of this committed law for February has already run into clashes between partners on fundamental issues, especially those related to possible tax exemptions for large homeowners. But not only, because according to sources from the purple party there are also discrepancies on the need to force large landowners to dedicate a part of their homes to social rent, on the permanent prohibition of evictions without housing alternative to vulnerable families and on the placing implementation of effective measures to mobilize the exit of empty housing to the rental market.
The Executive will declare this Tuesday the coronavirus as a professional disease for the toilets that get infected, instead of a professional contingency derived from an accident at work as up to now, according to the ‘Cadena Ser’. In this way, health workers affected by the coronavirus who continue to be in the front line of the fight against the virus will have coverage for life if they suffer from diseases derived from the coronavirus. Congress had already unanimously approved in the Health Commission a non-law proposal of the Plural Group to consider occupational disease the sick leave of health or socio-health personnel.
