The Superior Court of Xustiza de Galicia (TSXG) has issued five sentence reductions for the comprehensive guarantee of sexual freedom law, known as the ‘law of only yes is yes’. The total number of reviews has been eight, and no excercellations have been recorded.

These are some of the data included in the latest update published this Wednesday by the General Council of the Judiciary (CGPJ), where it increases to 1,155 sentence reductions and 117 releases in application of the rule that came into force on 7 December. October. The reductions represent 31.4% of the cases reviewed.

In a press release, collected by Europa Press, the governing body of the judges indicates that the data as of July 1 was collected from the Supreme Court, the National Court, the superior courts of justice (TSJ) and the provincial courts. This latest update slightly increases the number of reductions and releases, which on June 1 stood at 1,127 reductions and 115 releases.

Regarding the Galician Provincial Courts, the Court of A Corua has reviewed 53 cases and decreed the reduction of the sentence 17 times. In the case of the one in Lugo, there have been nine revisions; six, sentence reductions; and with a release.

The Provincial Court of Ourense has notified 13 revisions, with nine sentence reductions and two releases; while that of Pontevedra has registered 32 case reviews, 19 reductions and two other releases.

THE ONE OF MADRID, THE HIGH COURT WITH THE MOST REDUCTIONS

At the national level, and according to the tables offered by the press office of this body, the Supreme Court has issued 31 sentence reductions –issued in cassation appeal–, which represents 36.5% of the total revisions. made in the high court; the National Court only a reduction, 14.3% of the revisions; the Superior Courts of Justice 145 reductions with 10 releases, 34.4% of the total reviews they carried out; and the Provincial Courts 978 reductions with 107 releases, 27.6% of the reviews carried out.

The CGPJ also offers disaggregated data from the different TSJs, and Madrid stands out at the head of reductions with 49, followed by the Balearic Islands with 16, Andalusia with 12 and Catalonia also with 12. They are followed by the TSJ of Asturias with 9 reductions. sentence, Castilla-La Mancha with 8 and the Valencian Community with 7.

The Supreme Courts that have applied the least reductions are Cantabria (0), La Rioja (1), Castilla y León (2), and Pas Vasco and Extremadura (3). Regarding releases, the TSJ have determined 10: Navarra 5, Aragn 3, Andalusia 1 and the Basque Country 1.

The governing body of the judges qualifies that these data from the TSJ correspond to resolutions issued in appeals filed either against court rulings, or against resolutions issued by the provincial courts in the process of reviewing sentences.

THE PROVINCIAL COURT OF MADRID, 126 REDUCTIONS

As for the provincial hearings, the one in Madrid has reduced sentences in 126 cases out of a total of 489 reviews; that of Barcelona 60 reductions of 154 sentences reviewed; that of Valencia 58; that of Alicante 55 reductions; Cádiz 49; Vizcaya 42; Balearic Islands 48; and Seville 39. Of these, the one that has carried out the most releases has been Madrid with 16 followed by Cádiz with 8; Seville, the Balearic Islands and Vizcaya with 6; and Barcelona, ​​Burgos, Castelln, Murcia and Valencia with 5.

In contrast, the audiences that have applied the least reductions are those of Vila (0), Segovia (1), Soria (1), La Rioja (1), and Cuenca (2). Regarding releases, in the lower part are Valladolid, Teruel, Toledo, Soria, Segovia, Salamanca, Navarra, Lleida, León, La Rioja, Jan, Huesca, Granada, Guipuzcoa, Cuenca, Cáceres, Avila, Albacete and A Corua with no release.

The CGPJ indicates, however, that the data offered does not include the sentence reviews that may have been processed by the Criminal Courts, competent to prosecute crimes against sexual freedom punishable by up to five years in prison, given the difficulty of collecting this information. of the unipersonal organs.
