GAZA – Last week, South Africa became the first country to file a lawsuit against Israel at the International Court of Justice (ICJ) in The Hague, increasing international pressure on Tel Aviv to stop its deadly and relentless bombing of the Gaza Strip. The war in Gaza that Israel has been waging since October 7 2023, has killed more than 22,000 civilians, most of them children.

In an 84-page lawsuit that South Africa filed in court on December 29, it details evidence of the brutality committed in Gaza and asks the Court – the UN body for resolving disputes between countries – to immediately declare that Israel has violated its responsibilities under international law since 7 October.

The move is the latest in a series of actions Pretoria has taken since the start of the war in Gaza, including strongly and persistently condemning Israel’s attacks on Gaza and the West Bank, recalling South Africa’s ambassador to Israel, citing the suffering Israel is experiencing. Palestine to the International Criminal Court (ICC) and called for an extraordinary meeting of the BRICS countries to discuss the conflict. The ICC handles cases of alleged crimes committed by individuals, not states.

1. South Africa Accuses Israel of Carrying Out Genocide in Gaza

According to Al Jazeera, South Africa accused Israel of committing genocide in Gaza, which violates the 1948 Genocide Convention which defines genocide as “an act committed with the intent to destroy, in whole or in part, a national, ethnic, racial or religious group”.

The acts of genocide listed in the lawsuit include the killing of large numbers of Palestinians in Gaza, especially children; destruction of their homes; their expulsion and transfer; and enforcing a blockade on food, water and medical aid in the region.

This also includes implementing measures that prevent Palestinian births by destroying vital health services that are essential for the survival of pregnant women and babies.

All these actions, according to the claim, “are meant to bring about destruction [warga Palestina] as a group.”
