The freedom of the sociologist Mirel Palada is in the “pen” of the magistrate from the 2nd District Court who completed the file of refusal to collect biological samples, after he was caught by the traffic police from the Capital while driving drunk.
At the Thursday term of the trial, Palada also gave a statement, where he fully acknowledged the accusation, but justified it on the basis of alleged fears.
Concretely, Palada said in front of the case judge, “yes, I admit the act and I want to give a statement”.

Palada: I am a sociologist and I specialize in electoral surveys. I earn variable, per year I earn about 30,000 or 40,000 euros.
Judge: Why did you refuse to submit and refuse to collect the biological samples at the INML?

Prosecutors want the sociologist in prison
For his part, the prosecutor present at the court session requested the judge of the case to establish a prison sentence for Mirel Palada.
The magistrate reminded that he already has a previous criminal conviction with suspension, in which case, a new conviction carries with it, according to the laws in force, the transformation of the resulting final punishment into one with execution in detention.
Another reason of the prosecutor invoked in the courtroom was represented by Palada’s conduct at the time of committing the criminal act.
“We are talking here about the defendant’s conduct. He invoked religious issues. And he claimed that he did not know that the refusal to take evidence is not a criminal case. Or the simple ignorance of the law does not bring with it the absolution of criminal responsibility”, explained the magistrate
The 2nd District Court remained in judgment on Thursday and set the announcement of the verdict on November 16.

Sociologist Mirel Palada, former spokesman of the Ponta Government, was sent to court by the Prosecutor’s Office attached to the District 2 Court, after he refused to have biological samples taken to determine his blood alcohol level, following a traffic control carried out by the policemen of the Road Brigade.
The file was sent to court at the beginning of April, being debated in the preliminary chamber, and on May 5 a magistrate confirmed the legality of the indictment drawn up by the prosecutors.
“On 04.04.2023, the Prosecutor’s Office attached to the 2nd District Court of Bucharest ordered the referral to the 2nd District Court of Bucharest regarding the defendant Palada Theodor Mirel, investigated in a state of freedom, for committing the crime of refusing or evading to the taking of biological samples provided for by Article 337 of the Penal Code.
The fact is that, on 08.10.2020, around 11:30 p.m., the defendant drove the Mercedes car on CA Rosetti street no. 32 in the municipality of Bucharest, sector 2, emanating alcoholic breath, was taken to the headquarters of the INML, where he refused to take biological samples in order to determine his blood alcohol level,” reads a response from the Prosecutor’s Office.
In December 2020, Palada was sentenced to 9 months in prison with a suspended sentence, because in 2017 he hit former USR senator Mihai Goţiu during the break of a TV show.
The two were participating in a political debate show on the B1 TV station, and during the commercial break, Mirel Palada physically assaulted Mihai Goţiu.
