The lawsuit is filed by a resident of the Netherlands who had submitted her information to be registered on the electoral roll in order to exercise her constitutional right to vote in the 2023 national elections.
However, “on 1.3.2024 she received in her personal email which she had submitted to the Home Office an email containing an unsolicited political communication from a member of the European Parliament with whom the claimant had absolutely no previous interaction”.

What does the plaintiff plead?
Specifically, the plaintiff invokes a violation of articles 5, 6, 12 and especially 32 par. 4 of the GDPR, with an emphasis on the failure of the Greek State to ensure that persons who have access to personal data act only on the instructions of the data controller.
