DNA notified the Court of Constance in relation to the first case of fraud to the PNRR funds perfected by the anti-corruption prosecutors, in which the owner of a design studio is involved, accused of having presented false documents to win a contract for the construction of a Constanţa hospital, Agerpres transmits.

The prosecutors of DNA ordered the referral to the Court of Constance with a plea agreement concluded with an entrepreneur for having committed the crimes of illegal obtaining of funds and improper participation (in the form of instigation) in an attempt to use or present false, inaccurate or false or declarations or incomplete, if the act involves the obtaining of European funds illegitimately and falsely in documents under private signature, in continuous form.
In the press release released on Friday DNA does not mention his name, but according to the court portal and the local press he is the entrepreneur Victor Alexandru Ciobotaru, majority shareholder of Atlas Consulting & Proiect SRL, leader of the business association that won a contract for the development of the economic technical documentation for the project “Construction and equipment of the Municipal Polyclinic Hospital” in Constanţa.
According to the DNA, in the course of 2021, as part of the organization by the Municipality of Constanta of an auction for the acquisition of the service of preparing the technical-economic documentation relating to the investment objective “Construction and endowment of the Municipal Polyclinic Hospital “, financed through the National Plan for Recovery and Resilience, the entrepreneur allegedly presented several false documents.

These steps would have led the entrepreneur’s company, as leader of the association, to win the respective tender in the conditions in which it did not meet the eligibility conditions.
Shortly after the signing of the contract, on 7 October 2021, the municipality of Constanta paid the entrepreneur an initial invoice in the amount of 1,729,677 lei, for pre-feasibility services.
With the start of the second phase, that is the feasibility study and the presentation of the documentation to obtain the approvals and agreements required by the town planning certificate, dysfunctions in the execution of the contract would have arisen, on that occasion the representatives of the Municipality learned that none of the partners, with the exception of the entrepreneur, was not aware of the signing of the service contract, nor had they participated in the preparation of the pre-feasibility study.
These aspects led the employees of the Constanţa municipality to file a criminal complaint against the winning company and its legal representatives.
In the course of the investigation, Victor Alexandru Ciobotaru admitted his guilt before DNA prosecutors and agreed to receive a sentence of one year and eight months of imprisonment, with the suspended execution of the sentence for a period of 2 years. supervision and the prohibition of certain rights.
However, this agreement must be approved by a judge of the Constance court.
He also paid part of the damage caused to the local budget of the municipality of Constanţa, for a total amount of 600,000 lei.
